This is not a solicitation from a lawyer.<\/strong><\/p>\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-23dcea1\" data-block-id=\"23dcea1\"><p class=\"stk-block-text__text has-text-align-justify\">\u2022 The Notice is to inform you about a lawsuit in which you are eligible to receive a payment under the Fair Labor Standards Act (\u201cFLSA\u201d), 29 U.S.C. \u00a7 201, <em>et seq<\/em>., to advise how your rights may be affected by participating in the Settlement, and to instruct you on the procedure for participating in this Settlement, if you so choose.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-572b339\" data-block-id=\"572b339\"><p class=\"stk-block-text__text has-text-align-justify\">\u2022 Plaintiff, Jodi Cocagne (\u201cPlaintiff\u201d), filed this action against Defendant, Morley Companies, Inc. (hereinafter, \u201cMorley\u201d or \u201cDefendant\u201d) on behalf of hourly Customer Service Representatives (\u201cCSRs\u201d) employed by Morley between April 26, 2021 and November 11, 2024 (\u201cRelevant Period\u201d) who worked at least 40 hours in one or more workweeks.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-11b23c8\" data-block-id=\"11b23c8\"><p class=\"stk-block-text__text has-text-align-justify\">\u2022 Plaintiff alleges that Defendant failed to properly pay hourly, non-exempt CSRs and that these failures resulted in unpaid overtime under the Fair Labor Standards Act and Michigan wage laws.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-6c1f9e2\" data-block-id=\"6c1f9e2\"><p class=\"stk-block-text__text has-text-align-justify\">\u2022 Defendant expressly denies Plaintiff\u2019s allegations and asserts that at all relevant times they have paid their employees properly. By entering into the Settlement, Defendant does not admit any liability or wrongdoing.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-60c127d\" data-block-id=\"60c127d\"><p class=\"stk-block-text__text has-text-align-justify\">\u2022 The Settlement is the result of good-faith, arm\u2019s-length negotiations between the Plaintiff and the Defendant, through their respective attorneys. Both sides agree that, considering the risks and expense associated with continued litigation, this Settlement is fair and reasonable.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-bcf9d14\" data-block-id=\"bcf9d14\"><p class=\"stk-block-text__text has-text-align-justify\">\u2022 As part of the Settlement, Defendant will pay a gross amount of $900,000 to be allocated among you and other CSRs (\u201cPutative Collective Members\u201d). The process of how the Settlement amount is being distributed is set forth in Section 2 and 3 in the Notice. The Court has entered an Order approving the Parties\u2019 Settlement Agreement (the \u201cApproval Order\u201d).<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-4306753\" data-block-id=\"4306753\"><p class=\"stk-block-text__text has-text-align-justify\">\u2022 You are receiving the Notice because based on the Defendant\u2019s records you are eligible to participate in the Settlement and to receive payment from the Settlement.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-2dcf18c\" data-block-id=\"2dcf18c\"><p class=\"stk-block-text__text has-text-align-justify\">\u2022 Pursuant to the Court\u2019s Approval Order, all Putative Collective Members who timely return a claim consent to join the lawsuit (i.e., \u201cSettlement Collective Members\u201d) will release certain claims against Defendant, as described in Section 7 in the Notice, in exchange for a share of the Net Settlement Amount. You can submit a Claim Form online <strong><a href=\"https:\/\/www.csrflsasettlement.com\/index.php\/cocagne-morley-claim-form-login\/\">HERE<\/a><\/strong>.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-ac9cf43\" data-block-id=\"ac9cf43\"><p class=\"stk-block-text__text has-text-align-justify\">\u2022 Claim Forms must be returned within 45 days of the date they are mailed by the Claims Administrator. Failure to timely return your claim will exclude you from the Settlement and you will not receive a Settlement payment as a result of the Settlement. You may return your Claim Form by mail, email, or online <strong><a href=\"https:\/\/www.csrflsasettlement.com\/index.php\/cocagne-morley-claim-form-login\/\">HERE<\/a><\/strong>.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-618c176\" data-block-id=\"618c176\"><p class=\"stk-block-text__text has-text-align-justify\">\u2022 You have 60 days to cash, deposit or cause to be deposited your check, and if you fail to do so, you will waive your right to payment but will be bound by the terms of the Agreement and have released your claims against the Defendant.<\/p><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">\u2022 The Court in charge of the case is the United States District Court for the Eastern District of Michigan.
